In response to questions relating to legislation permitting the recent management changes by Maritime Safety Queensland (MSQ), we have obtained the following information:

Stage 4 – no anchoring zone

The current no anchoring gazettal has been issued by virtue of s197 of the Transport Operations (Marine Safety) Regulation 2016. www.legislation.qld.gov.au/view/pdf/inforce/current/sl-2016-0154

At the introduction of the gazette, it states:

The gazette then goes on to list the co-ordinates that it applies to, which have also now been updated on MSQ’s website at www.msq.qld.gov.au/about-us/news-and-stories/changes-for-boating-on-noosa-river

Stages 5 & 6 – further anchoring restrictions as outlined on MSQ’s website (link above)

We have been advised that the legislation applicable for Stages 5 & 6 changes is the Transport Infrastructure (Waterways Management) Regulation 2012, and changes are still required. As with Stage 4, specific details of any changes to be introduced are not available until the legislation process has been completed.

It is important to note that both pieces of legislation mentioned are subordinate legislation, which does not come before Parliament for MPs to debate or vote on.
